I’m a Photographer specializing in natural lifestyle photography. My photos have a unique and natural style. I believe that it is these features of my photos that convinced you (the Client) to take advantage of my offer. Bearing in mind the above, you confirm that you are familiar with my achievements and accept my style of photography, the perception of the frame, image, colours of the photos taken, as well as agree to my artistic photographic interpretation of the photos.
It should be remembered that the final effect of the photos is influenced not only by the moods of the models but also the weather conditions during the session, which, unfortunately, are beyond our control. And if the session takes place at home, the lighting conditions in the interior.
1. Booking a photo session is tantamount to accepting all T&C regulations. All disputes and settlements will be considered concerning the points of T&C regulations.
2. Booking and Payment
The Client willing to attend sessions must entrust the Photographer with their name and surname, e-mail address and telephone number to enable contact in matters related to information and the provision of services.
Arranged time and date will be pre-hold for the Client for 24h, non-refundable session fee in the full amount of £25 must be received by that time. If the Client fails to pay the session fee within that time, must contact the Photographer again, to check availability. Upon receiving the session fee, the Photographer will reserve the time and date agreed upon and will not make other reservations for that time and date.
The remaining balance for the selected package is due on the day of the Client’s photography session and is payable before shooting begins. The Client agrees if the balance is not paid at the time of the session, the Photographer cannot guarantee to attend their photography session.
3. Location costs & fees
If a requested location has any costs/fees associated, you, the Client, will be responsible for those fees. The travel cost within a radius of 15 miles from CV21 Rugby, Warwickshire is included in all price packages. All miles more than above distance is charged at 35p per mile.
4. Cancellations/postponement
The Client understands that by entering into this agreement, the Photographer is foregoing other photographic jobs. Due to diary booking based business, the appointment can only be rescheduled free of charge up to 7 days before the agreed date, except for special circumstances like a child or parent/parent’s illness (this also will be accepted as a once-off).
The session can be cancelled half an hour before the agreed date in the event of gusty rain, strong wind, or a storm. Dark clouds and low temperature are not the reason for cancelling photos. If the session can’t take place on a scheduled day due to weather, the Photographer and the Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
5. Cooperation/no shows
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract.
The Photographer is not responsible if the Client and/or key individuals fail to appear or cooperate during the session. Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders the Photographer’s ability to obtain quality shots.
6. Responsibility for health and property
When deciding to take an outdoor session, the Client must be aware that the open-air consists of insects, animals, plants, water, mud, sand and all the wonderful nature. Proper protection, e.g., against ticks or mosquitoes, is on the customer’s side. He cannot blame the Photographer for an ant bite or scratch on his leg. When moving through fields, meadows, forests, or a world made of concrete, both sides observe common sense and generally accepted safety rules.
For home sessions, the Client must clean the apartment carefully, arrange toys, hide protruding cables, liquids or packaging with large logos. Neon clothes also often fall into the frame and background, so it’s a good idea to hide them. If you have an idea to take photos that show real everyday life, the apartment may remain in the state in which you operate daily, but after the session, it will not be possible to remove something graphically from the frame and photos. If you are afraid that your apartment is not suitable for photos, send me photos so that I can assess it myself before the session.
7. Editing and delivery
The client declares that they have read the portfolio of the Photographer and accepts my style of taking photographs along with the method of their processing. The Photographer does not use Photoshop, and thus does not remake the silhouettes, does not slim down, does not remove the inscriptions on T-shirts, clothes, does not stick faces, eyes and other parts of the body. Modifications to the appearance only concern the removal of individual blemishes, minor bruises, cuts that are not permanent. The Photographer does not attempt to retouch the entire skin, smooth the face or change the figure.
The Photographer has full rights to make the selection of the photographs that reflect their style and quality of work. During the image selection process, any images that are not suitable for selection are removed and not available to the client. The Client will receive a link to a private gallery with all processed photos (via the zalamo.com website) up to 14 working days from the day of the session.
The Client is responsible for viewing and ordering photos in the amount consistent with the selected package from their online gallery within 7 days of receiving the gallery, otherwise, the Photographer selects them. Reloading images in the gallery costs £10. If the Client chooses photos outside the package, they must be paid for immediately after making the choice. After selecting and paying for additional photos, within 24 hours Client will be able to download high-quality images via Zalamo.com.
8. Copyright
The Photographer undertakes to protect the Client’s image by not sharing photos without their knowledge and prior consent for any purposes other than those indicated below, and not sharing any of the Client’s personal data other than names. Information on the processing of personal data can be found in the Privacy Policy, and by participating in the session Client accept its terms.
The opportunity to show off the photos taken by yourself is an important element in the activity of every photographer. For this reason, Photographer wants to be able to put photos on a website, blog and social media platforms, sometimes also in printed promotional materials – i.e., in albums, on a paper leaflet.
By participating in the session, the Client’s consent / do not consent to the use of their image and names for the promotion of Photographer’s work in the manner described above. The client must inform about their consent on the day of the session or after viewing the gallery. Remember, following the law, consent to share the image may be withdrawn at any time.
All images and copyrights are the property of the Photographer. The Photographer retains these rights even if image files are turned over to the Client. By receiving the photos, the Client has the right to use them for non-commercial purposes, including distribution, printing or duplication (license). This means that the Client can freely share them with family and friends, copy them and develop them for binding, etc. Photographer does not agree with cropping photos, applying filters on Instagram and any modifications to the final appearance of the photo taken by the Photographer.
The use of photos for commercial purposes such as advertising, promoting, marketing my the services and packaging any product, selling, etc. requires the Photographer’s prior written consent.
9. Liability
The photographer is not responsible for any injuries inflicted upon any participating parties. The Client agrees that is responsible for all parties involved with the agreed-upon Photography Session. If there is an individual involved in the Photography Session who does not agree to the terms of this agreement the Client assumes responsibility for any liability.
10. Limit of liability
Although the photographer shall exercise all reasonable skill, care and diligence in the discharge of her duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record, the photographer will only be responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs.
In the unlikely event that the Photographer is injured or becomes too ill to attend the Photography Session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, and the portrait session must take place on the scheduled date, Photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability are limited to the return of all payments received.
In the unlikely event of a total photographic failure or cancellation of this contract by either party or any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
11. RETURNS POLICY
Only incorrectly supplied items and items of poor quality can be returned within 14 days from the date of receipt of images and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error. Accordingly, the clients acknowledge that the images shall not be subject to rejection based on taste, aesthetic criteria, or personal appearance.
The regulations apply from 1st May 2021.
